Daily Wire+ advertises “lifetime Membership” access, but the term may not match typical expectations of lifetime service.

Background

Daily Wire+ advertises “lifetime Membership” access, but the term may not match typical expectations of lifetime service. Daily Wire+ launched its Lifetime Membership as a premium, limited-availability offering that grants ongoing access to all current and future All Access features. The membership is promoted as a one-time purchase with no renewals or expiration, and includes digital benefits and more. As part of the promotion, Daily Wire+ describes the membership as “future-proof,” stating that any new All Access features introduced over time are included for members.

Consumer-impact summary

Business Model

  • The scope of “Lifetime” access is determined by Daily Wire’s terms, which may not guarantee indefinite use as users might expect, potentially restricting how long members can actually access content.

User Freedom

  • The membership cannot be transferred, refunded, or moved between accounts, limiting user flexibility after purchase.

Definition and Implementation

According to Daily Wire’s Lifetime Membership Terms: “Lifetime” access is defined by Daily Wire’s terms and lasts until the earlier of: the natural lifetime of the member, the discontinuation of the Lifetime Membership by Daily Wire, or termination by the company for violating terms of use. Daily Wire may remove or convert components of the Lifetime Membership, including affiliated services (e.g., Bentkey Adventures, LLC), or offer alternatives if portions of the service are sold, transferred, or discontinued. Memberships are non-refundable, non-transferable (except for designated gifts). Additional services or future membership tiers may not be included unless explicitly stated or purchased separately.

Overarching problem

This practice highlights issues inherent in the use of “lifetime” for digital subscriptions:

Redefining Common Terms

  • The term "lifetime" is commonly understood to mean the entire life of the product
  • Potential Service Reduction: Portions of the membership can be removed, sold, or converted, meaning members may not receive all originally included features.

License vs. Ownership

  • Products marketed with "lifetime" access remain under licensing restrictions
  • Access can be cancel or discontinue the Lifetime Membership Subscription service at any time.[1]

Regulatory Response

California's AB 2426, effective January 1, 2025, addresses this type of advertising by requiring companies to:

  • Explicitly disclose when digital goods are licensed rather than owned
  • Clearly and conspicuously communicate access limitations & conditions
  • Obtain affirmative acknowledgment from consumers regarding license terms
