Creators' lawsuit (2025)
Online creators filed a class action lawsuit against Capital One, alleging that the company used cookies to override the commissions that content creators would've earned through affiliate marketing[2][3]. Addition of forced arbitration to TOS (2026)
On July 16, 2026 Capital One Shopping posted an updated Terms of Service Agreement which added a forced arbitration agreement. Those who agreed to the prior agreement have until August 20, 2026 with the old TOS. An option to reject the forced arbitration agreement was provided.
According to Capital One Shopping TOS as of July 18, 2026:
You may reject the arbitration agreement but only if we receive notice of rejection from you within 30 days of the effective date of this arbitration agreement or within 30 days of the effective date of a modification to this arbitration agreement, whichever is later.[5]
